SMS Terms

These SMS Messaging Terms apply to text messages sent by OptiMax Works, a DBA of Wellspring Search LLC.

Program Description

OptiMax Works may send text messages to individuals who have expressly agreed to receive them. Messages may include:

  • inquiry acknowledgements
  • requested follow-up
  • appointment confirmations
  • appointment reminders
  • rescheduling information
  • service-related updates
  • occasional marketing or promotional messages where separately authorized

Message frequency varies based on your interaction with OptiMax Works.

Consent to Receive Text Messages

By checking an optional SMS consent box or otherwise providing express consent, you authorize OptiMax Works to send text messages to the mobile number you provided.

Consent to receive text messages is not a condition of purchasing any goods or services.

Website SMS consent controls must remain optional and unchecked by default so the individual actively chooses whether to receive messages. (Twilio)

Message and Data Rates

Message and data rates may apply depending on your mobile carrier and service plan.

OptiMax Works is not responsible for charges imposed by your mobile carrier.

Opting Out

You may opt out at any time by replying STOP to any text message from OptiMax Works.

After you reply STOP, you may receive one final message confirming that you have been unsubscribed. No further marketing text messages will be sent unless you provide new consent.

You may also use other recognized opt-out words supported by the messaging platform, where available.

Supported Carriers

Mobile carriers are not liable for delayed or undelivered messages.

Message delivery is subject to the availability and operation of wireless networks and carrier systems.

Privacy

OptiMax Works handles personal information in accordance with its Privacy Policy: https://optimaxworks.com/privacy/

Mobile information, telephone numbers, and SMS opt-in consent data will not be sold, rented, or shared with third parties or affiliates for their marketing or promotional purposes.

Information may be shared with service providers that support message delivery and business operations, but only as reasonably necessary to provide those services.

A clear prohibition on sharing mobile opt-in information for third-party marketing is part of current A2P review requirements. (Twilio Help Center)

If these SMS Messaging Terms conflict with the general Terms regarding the SMS program, these SMS Messaging Terms govern the text-messaging program.

Changes to These Terms

OptiMax Works may update these SMS Messaging Terms periodically. Changes will be posted on this page with a revised effective date.

Continued participation in the SMS program after changes take effect constitutes acceptance of the revised terms, subject to applicable law.
